Right of withdrawal from the contract

  1. The Consumer may withdraw from the Sales Contract within 14 days without giving any reason.
  1. The period specified in section 1 begins on the delivery of the Product to the Consumer or to a person designated by the Consumer other than the carrier.
  1. In the case of a Contract covering multiple Products delivered separately, in batches or in parts, the period specified in section 1 runs from the delivery of the last item, batch or part.
  1. In the case of a Contract for the regular delivery of Products over a fixed period (subscription), the period specified in section 1 runs from taking possession of the first item.
  1. The Consumer may withdraw from the Contract by submitting a statement of withdrawal from the Contract to the Seller. To meet the withdrawal deadline, it is sufficient for the Consumer to send the statement before the deadline expires.
  1. The statement may be sent by traditional post, electronically by sending the statement to the Seller's e-mail address, or by submitting the statement on the Seller's website – the Seller's contact details are set out in Chapter I.
  1. If the Consumer sends the statement electronically, the Seller will promptly send the Consumer, to the e-mail address provided by the Consumer, a confirmation of receipt of the statement of withdrawal from the Contract
  1. Effects of withdrawal from the Contract:
  • In the event of withdrawal from a Contract concluded at a distance, the Contract is deemed not to have been concluded.
  • In the event of withdrawal from the Contract, the Seller shall refund to the Consumer promptly, and no later than 14 days from the date of receipt of the Consumer's statement of withdrawal from the Contract, all payments made by the Consumer, including the costs of delivering the item, except for additional costs resulting from the Consumer's choice of a delivery method other than the cheapest standard delivery method offered by the Seller.
  • The Seller will refund the payment using the same payment methods that the Consumer used in the original transaction, unless the Consumer has expressly agreed to another solution that will not involve any costs for the Consumer.
  • The Seller may withhold the refund until the Product has been received back or until proof of its return has been supplied, whichever occurs first.
  • The Consumer should return the Product to the Seller's address given in these Terms promptly, and no later than 14 days from the day on which the Consumer informed the Seller of the withdrawal from the Contract. The deadline is met if the Consumer sends back the Product before the 14-day period expires.
  • The Consumer bears the direct costs of returning the Product, including the costs of returning the Product if, due to its nature, the Product could not be returned by ordinary post.
  • The Consumer is liable only for any diminished value of the Product resulting from handling it in a manner other than what is necessary to establish the nature, characteristics and functioning of the Product.
  1. Where, due to its nature, the Product cannot be returned by ordinary post, information about this, as well as about the costs of returning the Product, will be provided in the Product description in the Shop.
  1. The right to withdraw from a contract concluded at a distance does not apply to the Consumer in respect of a Contract:
  • where the subject of performance is a non-prefabricated item, manufactured to the Consumer's specifications or serving to satisfy the Consumer's individual needs,
  • where the subject of performance is an item delivered in sealed packaging which cannot be returned after opening for health protection or hygiene reasons, if the packaging was opened after delivery,
  • where the subject of performance is an item that is liable to deteriorate rapidly or has a short shelf life,
  • for the provision of services, if the Seller has fully performed the service with the express consent of the Consumer, who was informed before the start of performance that they would lose the right to withdraw from the Contract once the Seller had fully performed,
  • where the price or remuneration depends on fluctuations in the financial market over which the Seller has no control and which may occur before the withdrawal period expires,
  • where the subject of performance consists of items which, after delivery, due to their nature, become inseparably combined with other items,
  • where the subject of performance consists of alcoholic beverages whose price was agreed upon when the sales contract was concluded, whose delivery may take place only after 30 days and whose value depends on market fluctuations over which the Seller has no control,
  • where the subject of performance consists of sound or video recordings or computer software delivered in sealed packaging, if the packaging was opened after delivery,
  • for the supply of newspapers, periodicals or magazines, except for subscription contracts,
  • for the supply of digital content not stored on a tangible medium, if performance began with the express consent of the Consumer before the withdrawal period expired and after the Seller informed the Consumer of the loss of the right to withdraw from the Contract.
